The contract of sale for the purchase of a home in New Jersey should contain the terms and the rate of interest that the purchaser is planning to pay. Once the application is made to the mortgagor, a mortgage commitment should be obtained within 30 to 45 days of the contract of sale. After the commitment is obtained the purchaser is required to deposit 10% of the price offered as earnest money which the seller will deposit in a bank account as escrow.
The most important part of any real estate purchase is a title search. The purchaser’s attorney, title search companies or a trust and title company are entrusted with the task of searching public records, bankruptcy court records and family court records for possible encumbrances on the title. Most title search companies are members of the New Jersey Land Title Association. After the title search has been completed it is wise to take out a title insurance to prevent possible legal actions based on discrepancies in title. If the contract is drawn up by a real estate agent, it is mandatory that a three day review period is granted to the purchaser. The State of new Jersey recognizes an implied easement which is given to anyone who has no other reasonable or practical way of egress and ingress except through the property of another.
The purchaser also requires a homeowners insurance for the amount of the mortgage which is required at the closure of the purchase. Before the closing of the contract the attorney will apportion the rates and levies to be paid by the purchaser and the seller. The purchaser should make arrangements to establish new accounts for taxes and other payments in the purchaser’s name. On the completion of these procedures, the purchaser will be required to execute the contract by showing the home owners insurance and obtain immediate possession.

Discount for Senior New Jerseyites
Just like getting the Denny’s grand slam for a buck or two less, New Jersey is offering their own senior discount for property tax. Its part of a property tax rebate incentive in the Homestead Act portion of New Jersey’s real property law. For those 65 or older and meet certain income requirements the provisions can possibly allow $250 deducted from their annual property tax payment.
This law is open to other senior such as those whose spouse or civil union partner has died. If you are a spouse or were in a civil union of a deceased New Jersey citizen that was 65 or older, you may be eligible for the same deduction of $250. Of course there are always some extra provisions. For example, in this case with the spouse/civil union, it would be noteworthy to mention that the petitioner would and could not be married or in a civil union and still get the same $250 annual deduction.
There are also another offering in the same vein for those who are under 65 and have been permanently or totally disabled can also be subject to the same deduction. This also works the same for the spouse or civil union half as described for those who apply that are over 65. The provision in this case is that the applicant would have to be 55 years of age or older at the time of the death of their spouse and would not have be permanently and totally disabled themselves.
These deductions are found in New Jersey’s Statues. More specifically, if you are law savvy or have a lawyer who can help, more detail can be found in the books under the call N.J.S.A. 54:4-8.41 and 41a.
Some New Jersey realtors may not be up on all the provisions with this law, so if you think you fit some of these profiles mentioned above, it would behoove you to mention this or check out your local law library to pursue.
Although it seems like just a small time ago Jersey homes could be bought with very little money as a down payment, and at times, with nothing at all — this also went for much of the U.S. Those doors have long since been slammed shut, bolted and padlocked as the folks who believed they were getting their dream home or big money investment are now being set out to dry.
Foreclosures hit Jersey pretty soundly, not as bad as those in California or Florida, but some counties suffered worse than others. So after a year or so of the Fed trying to monkey with interest rates and had little avail, members of the House or Representatives tried to pass some measures to ease up on mortgage payment pressures.
New Jersey Property Tax Reduction Measures
Recently Representative Rush Holt from New Jersey sponsored a proposal to reduce property tax — something that New Jersey as a state has the highest in the nation. There are also provisions for homeowners to write down their house costs by depleting inventories. This is all done so, even if they cannot maintain the payments on their home, they won’t have to eat too much cost when selling their homes off. Also, it is making the glut of empty New Jersey homes for sale more apt to be bought up.
So far it’s passed the House’s vote, but the Senate will be another matter. It tends to be supported mostly by Democrats since it’s asking the government to step in to fund a high-priced proposal. Republicans in both House and Senate tend to think those who got into risky loans should be responsible getting themselves out. Realtors lean more toward government help as it will show a quicker result for their industry.
One of the two part measure asks for 15 billion in loans and grants — the price tag that this measure is asking to help states with for buying and redeveloping foreclosed homes that are abandoned. The other measure asks for a 300 billion in loan guarantees through FHA so homeowners at risk could refinance their mortgages. Another caveat to the bill is that with the new bill FHA loan limits will be in place, and with these limits will be a fixed interest loan option with those who pay 3% down.
The last part is intended for those who plan to buy to own the home while warding off home investors (flippers as they are sometimes known as). Bush intends to veto this bill believing the opposite of this intention is true.
